2. Acceptance of Terms

By accessing or using the TRAiDMIN web and mobile application (“App”), you agree to these Terms & Conditions.
If you do not agree, you must not use the App.
This is a Closed Beta, invite-only release and may contain errors or incomplete features.

3. Eligibility

You must:
• Be at least 18 years old
• Be located in Australia
• Be a licensed HVAC contractor or authorised representative of a licensed HVAC business
• Have received an authorised invitation to use the Beta
We reserve the right to suspend or terminate accounts that do not meet these requirements.

4. Beta Status

This App is provided as a Closed Beta version.
You acknowledge that:
• Features may change without notice
• Functionality may be incomplete
• Bugs or interruptions may occur
• Data loss may occur
We may modify, suspend or discontinue the Beta at any time.

5. Description of Services

TRAiDMIN provides:
• AI-assisted conversational discovery for quoting
• Voice-to-text data input
• Software-based quote generation
• CRM functionality
• File uploads
• Image generation and copywriting tools
• Xero export integration (quotes only)
TRAiDMIN does not:
• Process payments
• Hold funds
• Issue invoices
• Provide financial advice
•Provide legal advice

6. AI Functionality Disclaimer

The App uses artificial intelligence tools to:
• Assist with conversational data capture
• Generate suggested materials and labour breakdowns
• Produce image and copywriting outputs
• Generate transcriptions of voice inputs
Important:
• AI outputs may contain errors.
• AI does not calculate financial values.
• All pricing, totals, and calculations are generated by software logic.
• Users are solely responsible for reviewing, verifying, editing, and approving all outputs before dispatch.
TRAiDMIN does not guarantee the accuracy, completeness, or suitability of AI-generated suggestions.

7. Quotes and Legal Responsibility

Quotes generated using TRAiDMIN are legally binding once issued to your customer.
You acknowledge that:
• You are solely responsible for all quote content
• You must include your own business Terms & Conditions
• You are responsible for compliance with Australian Consumer Law
• You are responsible for pricing accuracy
• You are responsible for regulatory compliance
TRAiDMIN is not a party to any agreement between you and your customers.
We are not responsible for disputes, losses, or claims arising from your quotes.

8. Xero Integration

The App may allow exporting quotes to Xero.
You acknowledge:
• Xero is a third-party service
• We are not responsible for Xero’s performance
• We are not responsible for invoice generation
• We do not access or control funds
Your use of Xero is subject to Xero’s own terms.

9. User Data & Customer Information

You may input:
• Business information
• Customer contact details
• Project information
Customer data entered into the App:
• Is visible only to you
• Is not used for marketing
• Is not soldIs not shared except as necessary for infrastructure hosting
You are responsible for ensuring you have lawful authority to collect and process your customers’ data.

10. Voice Transcriptions

TRAiDMIN:
• Does not store voice recordings
• Generates text transcriptions of voice inputs
• May access transcriptions for customer support, bug fixing, and product optimisation

11. Acceptable Use

You must not:
• Use the App for unlawful purposes
• Input false or misleading information
• Attempt to reverse engineer the software
• Upload malicious files
• Share access credentials

12. Intellectual Property

All software, branding, and technology remain the property of TRAiDMIN Pty Ltd.
You retain ownership of:
• Your business data
• Your customer data
• Your uploaded content

13. Limitation of Liability

To the maximum extent permitted by Australian law:
TRAiDMIN Pty Ltd is not liable for:
• Business losses
• Lost profits
• Indirect or consequential damages
• Quote inaccuracies
• Pricing errors
• Customer disputes
• Regulatory penalties
• Data loss during Beta

14. Indemnity

You agree to indemnify TRAiDMIN Pty Ltd against claims arising from:
• Your quotes
• Your business practices
• Your customer disputes
• Your breach of these Terms

15. Account Termination

We may suspend or terminate your access at any time, especially if:
• You breach these Terms
• The Beta ends
• We detect misuse

16. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
